Elmoda Event Hire Terms and Conditions
These Terms and Conditions apply without exception to all hire arrangements made between the hirer and Elmoda Event Hire. Please ensure that you read these Terms & Conditions carefully before hiring our products. Please note that when you place an order with us, you are agreeing to be bound by these Terms & Conditions.
- All hired items remain the property of Elmoda Event Hire.
- To secure the booking, a 20% fee is required for all orders over £100. For orders under £100, payment is required in full. This fee is non-refundable. Your date is not secured and your order is not confirmed until the booking fee has been received.
- Elmoda Event Hire will not be held responsible for any injury or damage to persons or property, howsoever sustained, arising from any items under hire.
- During the hire period, the hirer will be solely responsible for the hired items, including insurance of the items from the period of accepting the items to returning the items to Elmoda Event Hire. In the event of loss and/or damage to items, howsoever incurred, the hirer will be responsible for paying the full replacement cost.
- A loss and/or damage surcharge is added to the overall total and will be fully refunded subject to all items being returned in the condition of which it was hired. This will only be used in the event of any damage or loss that may occur. If the total value exceeds the surcharge, an additional charge will be made by the hirer.
- Hired items must be ready for collection at the agreed location at the correct date and time. All deliveries and collections, including those aborted, will be charged for. Hired items that are collected from us by the hirer must be returned on the agreed date and time, or the hirer will incur a further charge.
- The hire period for all items is 24 hours, excluding the day of delivery and collection. Any additional days will be charged at a daily rate unless otherwise agreed prior to the event between Elmoda Event Hire and the hirer.
- Final payment is required in full 6 weeks prior to the event.
- In the event that the hirer wishes to change the hire date, if the new date is available the booking will be changed at no extra charge. If the new date is not available and no alternative date can be agreed between the hirer and Elmoda Event Hire, the booking shall be deemed to have been cancelled.
- Cancellations must be made in writing. In the event of a cancellation the booking fee is non-refundable. For any cancellations with less than 6 weeks notice, the full payment is required.
- Elmoda Event Hire will not be held responsible or liable for any failure or delay in the performance of its obligations caused by, directly or indirectly, forces beyond its control. These include acts of God (fire, flood, etc), loss or malfunctions of utilities, weather conditions, strikes, work stoppages, accidents or any other unforeseeable circumstance that prevent the promise of its services. Elmoda Event Hire shall use reasonable efforts to resume performance when possible, under the circumstances. If the event prevents Elmoda Event Hire from providing its hire services on the event date, Elmoda Event Hire will have the right to cancel the booking immediately by giving written notice to the hirer.
- In the event that Elmoda Event Hire has to cancel your booking due to destruction of prop hire/venue décor, a refund will be given only for those items undeliverable.
- British Law shall govern the contract which incorporates these terms and conditions and the parties agree to submit to the exclusive jurisdiction of the English courts.
- Elmoda Event Hire reserves the right to review and update the Terms and Conditions periodically.
